Das Bundesgericht bejahte in einem weitreichenden Urteil den Anspruch der von Strassenlärm betroffenen Anwohnerinnen und Anwohnern auf Wiedererwägung einer rechtskräftigen (Sanierungs-)Verfügung eines in der Vergangenheit bereits sanierten Strassenabschnitts, weil sich die Verhältnisse seit Erlass der Verfügung erheblich geändert hätten. Neue wissenschaftliche Erkenntnisse und neue, darauf beruhende Rechtsprechung würden diesen Anspruch auf Wiedererwägung begründen. Die Folgen des Urteils sind nicht zu unterschätzen; die für Strassenlärmsanierungen zuständigen Behörden trifft wohl künftig die Pflicht, bereits sanierte Strassen in periodischen Abständen auf die tatsächlichen Verhältnisse zu überprüfen. Aus Gründen der Verhältnismässigkeit sollte aber bei länger zurückliegenden Sanierungen nur mit Zurückhaltung eine Pflicht zur «Dauersanierung» anerkennt werden.
Heute eröffnete die Staatskanzlei des Kantons Zürich die Vernehmlassung zum Gesetz über digitale Basisdienste, die bis zum 13. Mai 2024 dauern wird. Die Vorlage ist ein wichtiger Meilenstein auf dem Weg zur digitalen Verwaltung.
