Veröffentlichungspraxis von Schiedssprüchen der «Appeals Arbitration Division des Court of Arbitration for Sport»

Die Appeals Arbitration Division (Berufungskammer) des Court of Arbitration for Sport (CAS) ist zuständig für Berufungen gegen Entscheide von Sportverbänden, -vereinen, -organisationen sowie auch von nationalen Sportschiedsgerichten, insofern eine Schiedsvereinbarung vorliegt. Da die internationalen Sportverbände zumeist Schiedsklauseln in ihren Verbandsstatuten haben, ist die Appeals Arbitration Division praktisch die Hauptberufungsinstanz im internationalen Sport geworden (insb. betreffend Dopingstreitigkeiten). Aufgrund dieser, ja fast einzigartigen, Funktion in der internationalen Schiedsgerichtsbarkeit sind unterschiedliche Literaturmeinungen der Ansicht, dass die Berufungskammer des CAS die Veröffentlichungspraxis ihrer Entscheide überarbeiten sollte.[1]
