Constitutional and Administrative Law

Regulatory density and speed of regulation are steadily increasing as a result of new or amended laws, ordinances and guidelines. Our public law team follows developments in state and administrative law, and in particular in business administration law, closely in order to engage with our clients on all challenges in these areas and to assist them with the highest level of expertise, and to represent them before administrative bodies and the courts. Our clients include private individuals, public and private companies as well as public authorities (municipalities, cantons, federal government).

As lawyers, we accompany and represent our clients in public law matters before administrative authorities and courts at all levels of government (municipalities, cantons and the Confederation) and broadly based professionally. We also provide advice and support to our clients in dealing with legal risks and in the avoidance of legal disputes. We accompany our clients through difficult negotiations – whether on the part of individuals and companies or on the part of communities – in order to achieve the best results for them. We are at your disposal when it comes to reorganizing or outsourcing a branch of administration, creating and implementing new legal foundations, or drafting and negotiating service agreements and other administrative agreements. Based on ourin-depth knowledge of the proceedings and our independent position, we also conduct administrativeinvestigations for our clients. Finally, with our particular scientific background, we are performing peer review work to resolve specific legal issues in state and administrative law.

öff-recht blog: Strassenlärmsanierung als Daueraufgabe?

Das Bundesgericht bejahte in einem weitreichenden Urteil den Anspruch der von Strassenlärm betroffenen Anwohnerinnen und Anwohnern auf Wiedererwägung einer rechtskräftigen (Sanierungs-)Verfügung eines in der Vergangenheit bereits sanierten Strassenabschnitts, weil sich die Verhältnisse seit Erlass der Verfügung erheblich geändert hätten. Neue wissenschaftliche Erkenntnisse und neue, darauf beruhende Rechtsprechung würden diesen Anspruch auf Wiedererwägung begründen. Die Folgen des Urteils sind nicht zu unterschätzen; die für Strassenlärmsanierungen zuständigen Behörden trifft wohl künftig die Pflicht, bereits sanierte Strassen in periodischen Abständen auf die tatsächlichen Verhältnisse zu überprüfen. Aus Gründen der Verhältnismässigkeit sollte aber bei länger zurückliegenden Sanierungen nur mit Zurückhaltung eine Pflicht zur «Dauersanierung» anerkennt werden.

Heute eröffnete die Staatskanzlei des Kantons Zürich die Vernehmlassung zum Gesetz über digitale Basisdienste, die bis zum 13. Mai 2024 dauern wird. Die Vorlage ist ein wichtiger Meilenstein auf dem Weg zur digitalen Verwaltung.
