ICSID Tribunal upholds jurisdiction over claims by Swiss Construction Company against the Republic of Kosovo

Bratschi successfully represented Mabco Construction S.A., which is part of the global engineering and construction group Mabetex, in the jurisdictional phase of an ICSID arbitration brought under the Kosovo-Switzerland BIT and the Kosovo Investment Law against the Republic of Kosovo relating to the acquisition of shares.
In its Decision on Jurisdiction issued on 30 October 2020 the ICSID Tribunal by majority confirmed that it has jurisdiction over all of Mabco Construction S.A.’s claims.
The Bratschi team included former Counsel Dr. Christian Schmid, Partner Sandra De Vito Bieri and Senior Associate Liv Bahner (all Litigation and Arbitration).
