  • Development and worldwide registration (including administration) of intellectual property rights (in particular, copyright, trademark, company name, and design rights, as well as patent rights in cooperation with external patent attorneys)
  • Representation before civil courts and the Swiss Federal Institute of Intellectual Property (IPI) in the enforcement and defence of intellectual property rights, in particular concerning trademark disputes and breaches of unfair competition law (Unfair Competition Act)
  • Conseils juridiques complets concernant les projets de cloud computing, d'outsourcing, de plateformes et d'autres projets TIC
  • Drafting and negotiating of license agreements for the licensing of IP-rights and data
  • Drafting and negotiating of software development-, IT-, know-how-, R&D-, distribution-, and other IP related contracts
  • Data protection compliance - comprehensive advice on implementing and complying with the requirements of Swiss and European data protection law (FADP and GDPR), in particular for implementing new business models and new technologies (BIM, IoT, AI, Chatbots etc.)

Die Strafbestimmungen des neuen Datenschutzgesetzes

Das neue Datenschutzgesetz (DSG) enthält schärfere Strafbestimmungen als das alte DSG: Es sieht mehr Straftatbestände und höhere Bussen vor. Der Eidgenössische Datenschutz- und Öffentlichkeitsbeauftragte (EDÖB) darf neu Verfügungen erlassen, hat aber nach wie vor keine Kompetenz, um Bussen zu verhängen. Dafür sind die kantonalen Behörden bzw. Gerichte zuständig. Der EDÖB ist nicht strafantragsberechtigt, kann aber Strafanzeige erstatten.
